A Draft Law on Investment Funds According to EU Rules Presented in Ukraine
In Ukraine, a restructuring of the investment fund market is planned according to European rules with the aim of attracting private capital into business, real estate, and long-term projects. The draft law "On Investment Funds" has been registered in the Verkhovna Rada. The document was developed by the National Securities and Stock Market Commission (NSSMC) in collaboration with the Verkhovna Rada Committee and the World Bank. The draft law divides investment funds into public UCITS and alternative AIF, and also creates legal conditions for venture capital, real estate, and social entrepreneurship. Founders will be able to choose the form of the fund depending on the strategy. New requirements for asset management, property valuation, and transparency are introduced, as well as custodial institutions for asset storage. The draft law opens up opportunities for international operations, defining rules for Ukrainian funds in EU markets and for European funds in Ukraine. Existing institutions will receive a transitional period to adapt to the new requirements. The NSSMC expects that the new model will stimulate the attraction of private funds for financing Ukrainian business and infrastructure. The reform is in line with Ukraine's Euro-integration commitments.
