The U.S. Commodity Futures Trading Commission (CFTC) has filed a lawsuit against the state of Utah regarding regulatory authority over predictive markets. After Utah classified the predictive market platform Kalshi as an illegal gambling operation, the CFTC asserted its exclusive federal oversight authority and initiated legal action. On the 27th, the CFTC filed a lawsuit in the U.S. District Court for Utah against the state government and Attorney General Derek Brown, claiming that the state's regulatory actions infringe upon the federal agency's authority to oversee commodity derivatives markets. CFTC Commissioner Michael Selig emphasized in a statement that Congress has granted the CFTC exclusive authority. This lawsuit marks the CFTC's tenth lawsuit against a state government, having previously sued Arizona, Connecticut, Illinois, New York, Wisconsin, Minnesota, Rhode Island, New Mexico, and Kentucky. In contrast, Utah claims that Kalshi violates state gambling laws by offering betting on sports and political events, stating that Kalshi has caused ongoing harm to residents. The dispute over oversight authority for predictive markets is ongoing in several state courts and may escalate to the Supreme Court.
