Will tokenized collateral in the EU be convertible to liquidity during a default?

What ESMA is asking about tokenized collateral in central clearing
The authority wants to understand under what conditions EU central counterparties (CCPs) can use these assets safely and effectively. The consultation starts from here.
In the press release dated October 11, 2026, the European Securities and Markets Authority explains that the investigation concerns the transfer, management, protection, and use of collateral. It describes tokenization as a technology moving out of the testing phase into the operations of financial markets.
The mobilization of collateral, it adds, is a particularly relevant topic for central clearing.
The goal is to understand how tokenized schemes work in practice and how the current framework can accommodate them. The feedback will guide the authority's choice on whether to take regulatory or supervisory convergence action, within its competencies.
Verena Ross, the chair, has linked the initiative to the goal of growing tokenization safely and at scale in the single market. In her view, cross-border tokenized markets require legal certainty, interoperable infrastructures, and adequate supervision. However, they can improve efficiency and integration.
Collateral must remain usable even in the event of a default
The testing ground is the default of a clearing member. The consultation asks how tokenization impacts the entire lifecycle of collateral precisely at that moment.
Participants are asked to assess the ability of clearinghouses to obtain the assets, move them, and convert them into liquidity when needed.
Klaus Löber, chair of the authority's CCP Supervisory Committee, emphasized that technological changes must not affect fundamental protections. Collateral must maintain high quality, legal applicability, strong liquidity, and operational readiness, even under stress conditions and after a member's default.
The investigation also gathers opinions on changes in the risk profile of already admissible collateral. According to Cointelegraph, the questions touch on delays related to reimbursement, restrictions on transfers, and whether the transfer of a token grants ownership of the underlying assets or actionable rights over them.

Digital twins and native assets on DLT under examination
The consultation looks at three models: digital twins, assets born directly on distributed ledger technology (DLT), and hybrid solutions. Digital twins are tokenized versions of assets that remain within the traditional infrastructure.
The examination also concerns the relationship of these models with tokenized money and other settlement assets.
For tokenized collateral in the EU, the review checks how distributed ledgers connect with conventional infrastructure, without compromising customer protection, segregation, and settlement finality. Among the settlement assets analyzed, Cointelegraph indicates stablecoins, central bank money, and tokenized deposits.
Live clearing provides the backdrop
Tokenization has already entered European clearing operations, driven by banks and investors seeking quicker access to securities to cover margin requirements. Cointelegraph reminds us of this.
In July 2025, Eurex Clearing launched a DLT-based collateral service. JPMorgan completed the first real transaction, transferring securities from a separate custody location on behalf of the Dutch pension investor PGGM.
The same source links the consultation to the launch of Pontes in September by the Eurosystem. Pontes allows for the settlement of transactions on tokenized assets with central bank money. According to the report, ESMA sees it as a potential link between blockchain infrastructure and existing settlement systems for collateral.
How to participate and what the next steps are
Stakeholders can submit contributions through the consultation webpage until January 15, 2027. Responses will be published after the closure, unless participants request otherwise.
ESMA will evaluate the feedback in the first quarter of 2027, alongside its broader work on tokenization, before determining what action to take.
