The Law No. 74-25 of the new Penal Code of the Dominican Republic, effective since August 2026, explicitly mentions crypto assets such as bitcoin (BTC) but only in the context of crimes, without providing a complete regulatory framework. The law penalizes pyramid schemes that use crypto assets, specifying in its Article 240 that any fraudulent scheme that recruits people to hand over money or digital assets under false promises of returns is considered a pyramid scheme. However, the everyday use of bitcoin is not regulated, as Article 237 on simple fraud does not mention digital currencies, meaning that activities such as buying or making payments with bitcoin are not considered crimes. The Bitcoin Dominican group acknowledges that, although bitcoin has been included in the legislation, the work is not yet finished. Bills to regulate the crypto asset market are stalled in the Chamber of Deputies, preventing the advancement of proposals presented in early 2026. One of these initiatives seeks to classify cryptocurrencies as taxable assets and create a certification by the Superintendency of Securities Market, while the other proposes a broader framework with registration and supervision.
