South Korea proposes 69000 annual OTC tokenized securities cap per retail investor
South Korea’s financial authorities proposed a 100 million won (69000) annual net purchase limit for retail investors on over-the-counter tokenized securities platforms per exchange. The Financial Services Commission (FSC) announced on Oct. 1 that it will accept public comments from Oct. 2 to Nov. 11 regarding revisions to the enforcement decrees of the Electronic Securities Act and the Capital Markets Act. These proposals are part of the revised laws set to take effect on Feb. 4 next year, reflecting policy directions from a public-private consultative body on tokenized securities presented on Sept. 4. Eligible securities for tokenization include fractionalized investment products and conventional securities like stocks, bonds, and funds. During the public comment period, the FSC will consider industry suggestions, including raising the investment cap, lowering the minimum capital requirement for issuer account management institutions, and easing distributed ledger requirements. Proposed discussions include increasing the annual net purchase limit above 100 million won, reducing the minimum equity capital requirement below 4 billion won (2.8 million), and relaxing distributed ledger requirements.
